SCRANTON - A city woman was arrested early Tuesday for allegedly threatening her ex-husband with a knife.

Katherine Miraval, 25, of Depot Street was charged with aggravated assault, burglary and reckless endangerment.

Police said Ms. Miraval's ex-husband, Rodrigo Palomares, was holding her in an upstairs room when Patrolman Leland Palmere arrived at 2232 Comegys Ave. for a domestic call just before 2 a.m. Ms. Miraval allegedly woke Mr. Palomares by entering his bedroom with a 12-inch kitchen knife, saying they would either rekindle their relationship or both die.

Oh boy: i did give him his residency to stay in the US, but i did it for love. After 5years of psychological abuse for 5years, he finally put me through the hospital in the beginning of the year, he punched me so hard in the head i was bleeding, my sister had to take me. That's how it all started, I was in love when i eloped my relationship, but i know for a fact.. that he wasn't. I believe two wrong doesn't make a right, I would never hurt anyone. Friends and school peers that know me, know how i am, and how im taking this divorce. I will leave it to my lawyer to represent me with the truth and with vital proof & I will get him back for false accusation.

To my defense, I was set up. I'am paying for the divorce, I had a PFA against him, but he had broken in to my home saturday while i was away for the weekend, and stold my old phone, at&t never deactivated my old phone sim card, and he went crazy with it, he saw that i was restarting my life with a person who i'am talking to now. He had called me and told me to come over his house and that he would give me back my phone, and threatened me that if i don't go, he would go back to his country- and not pay my dad which he owes a big amount of money. So I went, and i didn't think he would set me up like this. The door in the back was open, i didn't force anything, for god sake I'm 5'4 and 125lbs. I went to his room, he laying down (not sleeping), and then we were talking. All of a sudden, he threw a knife on the bed (which was hidden on top of shelf next to his bedroom door. He forcefully closed the door and said "now you are going to go through what i went, where is your boyfriend now?" Now i put him in jail twice, because he broke in to my house and destroyed my things, he is still not over the fact that i could go on with my life, and somehow wants to control me. I have proof of all of this, picture text he sent me that he had my phone, phone bills, threatening emails. I will be strong & with the help of my family, friends, and God.. I will go through this.

Just to correct MJP. Because of the ever growing problem with domestic violence, a deviation in applicable laws of arrest were made to more quickly arrest a perpetrator. All non viewable arrests must be made by warrant with few exceptions. Domestic violence being one of them. That does not mean a woman is given benefit of the doubt, although that is what the WRC believes. Recent signs of the domestic violence must be present and all other rules apply. And just to further clarify, the law does not specify the victim as being woman, it reads, "spouse", which is not gender specific. So when you say they, I hope you are refering to woman's rights activists and not law enforcement because the law does not provide for that so called benefit of the doubt you mentioned, in law enforcement. Subsequently, most of the reason for conflicts between WRC and the police, when they occur.

Let me guess how this went down: He got his green card when he married her, then he got rid of her because he didn't need her anymore in order to stay in this country legally, and then she went crazy because she thought they were actually in love. That would tick me off, because 1) I would look stupid and 2) he played the system.
OHHH BOY! 11/04/09 03:12
Nut Job!

How did she get in?? Does she have a key?? Or maybe she first gave him a roll in the sak and then he told her to leave and she wanted to stay,he said no and then she went for the knife. Talk about desperate. Love them and leave them thats my motto,no worries.

So WHAT. She always has a 12"knife for self defense. She was in a bedroom not the kitchen.Hope her lawyer has a better story.

Beer Battered Man,
Hopefully, he has obtained a PFA. After that, just like with women, he's pretty much on his own.
To be fair... 11/04/09 12:00

Tim 11/04/09 10:37
What?
If you read the article if says when police arrived he was holding her in a room because she threatened him with a knife.
Hooked on Phonics worked for me! 11/04/09 10:36
She could have pulled a "Bobbit" on him.
ouch! 11/04/09 10:28
He was holding her in a room against her will, and she pulls a knife in self defense and SHE is in the wrong?
What? 11/04/09 10:14
Good thing she had some clothes on when the cops responded!
Dispatch 11/04/09 10:12
The Observer,
Not to knock on your theories but if the woman has a kitchen knife that doesn't match the ones in the house, ( this is just an assumption I've made about the knife, and hoping that the police would think to check that ) and he has to keep her locked in a room; in his home not hers, until the police get there, I think its safe to say that she is likely the one at fault. Don't get me wrong do I feel that some times there is a sex bias in certain things yes, however generally in domestic violence cases they give women the benefit of the doubt not men. You may have a point with your idea's but you picked the wrong situation to apply them to.
