Man accused in rape, attempted murder of girl, 5

TAYLOR - A 40-year-old man has been charged in the brutal rape and attempted murder of a 5-year-old girl after a holiday picnic at her family's home, police said.

Felix E. Montoya, of 270 Tamworth Drive, was discovered half-clothed in the child's bedroom early Sunday by a shocked family who kept him at bay until police arrived. He was charged with rape of a child, attempted homicide and other offenses.

The victim was treated at a hospital for injuries to her face and head, adult bite marks on her thigh and shoulder and severe rape-related injuries, according the criminal complaint.

The Times-Tribune does not identify victims of alleged sexual crimes.

Shackled and handcuffed and clad in a hospital gown, Mr. Montoyo quietly told reporters he was "sorry" as he was led to arraignment before Magisterial District Judge Alyce Hailstone Farrell on Sunday afternoon.

According to a criminal complaint filed by Taylor Patrolmen Kevin Froese and Ryan Deluccie, the victim's family hosted an Independence Day picnic Saturday in their yard. Although unknown to the family, Mr. Montoyo attended as a friend of a friend.

The victim went to bed at about 10:30 p.m. At 2 a.m. Sunday, her parents began to clean up and checked on their children, only to find the victim's door locked. The mother knocked on the door and after a few moments, the girl opened it and ran out, her face red and swollen and her underpants on backwards. Mr. Montoyo was found under a bed wearing only tennis shoes and a T-shirt, police said. The father entered the room and cornered the man until police arrived.

Investigators found the girl's nightgown stained with blood and feces. At Community Medical Center, Dr. Michael Rogan of the Children's Advocacy Center and emergency room physician Dr. Vincent Pollino cataloged the girl's injuries: Severe bruising and cuts to the back, bruising and bleeding around the eyes consistent with strangulation, adult bite marks on shoulder and thigh, adult hand marks on her neck and right cheek and rape-related injuries significant enough to require surgery.

In court Sunday, Mr. Montoyo sat with his head down and hands tightly clasped, his knees shaking as the air conditioner kicked on.

As Judge Farrell contemplated bail, Mr. Montoyo noted that he had lived in the area for eight years, and in Brooklyn, N.Y., for 13 years before that. He told the judge he was born in Colombia, is married, has a job and two grown children.

First Assistant District Attorney Gene Talerico said given the heinousness of the crime and Mr. Montoyo's connections to Brooklyn, Colombia and Costa Rica, he would argue for "significant bail," although he did not specify an amount. Judge Farrell set bail at $200,000, and Mr. Montoyo was committed to the Lackawanna County Prison.

"In case someone posts this, you are not to have any contact with this little girl - not you and not anyone through you," she warned.

When asked if he had anything to say, Mr. Montoyo told the judge "I am sorry for real. I never did anything like this before in my life. It is stupid."

Mr. Montoya's preliminary hearing is scheduled for 10 a.m. July 15, in county court.

Maybe it is time to recall this knucklehead judge Farrell. I want a law and order judge that will NOT grant bail to felons like this, regardless where he comes from, but even more so when he has family overseas to flee to.

I am sick of these liberal left wing bleeding hearts. I am voting for Castellano. As the ADA in charge of child abuse crimes, I am sure he would never have let this guy walk on bail.

to Cheryl... wrong! The constitution does not demand bail. A person can be held on remand if the crime is violent enough or he poses a flight risk. Well, he has family in Columbia.. connections in Brklyn, I would say he is a flight risk.

Couldn't agree more with Frank. The Tri-Boro area is going to hell in a handbasket by letting these scumbags move in and run the place. I remember the days of being able to leave your car unlocked or your house unlocked and nothing ever happened. Forget it. You can't even walk your dog after dark without running into scum. I just hope the people of the Tri-Boro area don't sit back and expect that the politicians and police are going to handle the problem alone. The citizens of the Tri-Boro area are going to have to step up and help weed the scumbags out of the area for good.

WTF can Judge Alice Farrell be thinking allowing this animal bail?? She says "if someone posts this - have no contact", Are you kidding?? She should be stripped of her privilages as a judge! Does anyone realize he only needs 10% of 200,000 which is $20,000. He can easily post bail & flee to do this again & has probably done it before. He's practically confessed...Thank God the parents found him when they did or this maniac would've killed the child! The whole situation is sickening esp. the way it handeled by Judge Farell.

It is heartbreaking what this monster has done. He would have left my house in a black bag. The real sad part is that all are tax dollars will make sure he get's 3 squares and a bed!!! From I have read this man has a wife and two full grown children. He very well may get out on bail. That is 100% wrong. This bail should have been much higher or even flat out denied.

Bail? No. He should rot in jail. This act was pure evil and obviously the monster should not be released. As a mother of a 6 year old girl, this crime nauseates me. From watching the news, it does look like the man got beaten up. He had a big cut on his forehead. I hope justice is served but it will never fully take away this innocent child's trauma and emotional pain.

The judge shouldn't have given him a bail. He deserves to be under the jail, for the rest of his life.If it were my child, he would be at the coroners, and I would be in prison for the rest of my life, and I would be happy to go, for the sakeof my child.

This man could of been denied bail all tgether considering the brutality of the attack and his foreign ties. There are no regulations that would have prevented the judge from setting the bail at 1,000,000 dollars.

I completely agree with Steve-the Times Tribune should be ashamed to have written such graphic details of such a heinous crime. Why do we need to know such graphic detail? Do you really need to go so low for shock value? My thoughts and prayers are with this family and that poor little girl.
I hope that man gets what he deserves in jail.

And to add to my last comment since I saw what some others have said:

The reason these things happen in the world is because we are all born into sin. God gave us a choice from the beginning and man chose sin, so God cannot be "blamed" for these sick, perverted acts. Man is to blame because man is sinful (Romans 3:23). There is nothing good about man apart from the blood of Jesus Christ. Isaiah 64:6 clearly states that all the good things we do are as filthy rags in the sight of God when they are not done for His glory. They can never be done for His glory unless the individual has been saved by accepting that Jesus is His Son--believing that Jesus shed His blood and died as our substitute in order for us to be cleansed from our sin (raising again from the dead :)-that we could have a relationship with God...the only way to do that is for each individual to truly repent of their sin and accept Jesus as their Savior.

The only difference between a true believer in Christ and non-believer is that a true Christian has been forgiven of their sin by God. Whether you believe in God or not does not change the fact that God exists. We are all sinners and capable of these types of acts when not controlled by the Holy Spirit. This man obviously does not have a relationship with God and that is what he truly needs. I do not believe he should ever be let out in society again, but that is only because there are consequences to sin. Slowly, consequences are disappearing in this country and that one reason this country is not what it use to be. I love my country and pray for it constantly. I only hope that God chooses to have mercy on us......

HD you are incorrect, he has to post the full $200,000, this is a straight bail. Now if he went through a bail bondsman he would have to pay the a certain percentage to him which is usually 10%, but the bondsman keeps that money as his fee. This guy is not getting out of jail, and obviously most of you do not realize certain guidelines have to be followed when setting bail. You simply can't set it at 1,000,000 dollars.
