Man accused in rape, attempted murder of girl, 5

TAYLOR - A 40-year-old man has been charged in the brutal rape and attempted murder of a 5-year-old girl after a holiday picnic at her family's home, police said.

Felix E. Montoya, of 270 Tamworth Drive, was discovered half-clothed in the child's bedroom early Sunday by a shocked family who kept him at bay until police arrived. He was charged with rape of a child, attempted homicide and other offenses.

The victim was treated at a hospital for injuries to her face and head, adult bite marks on her thigh and shoulder and severe rape-related injuries, according the criminal complaint.

The Times-Tribune does not identify victims of alleged sexual crimes.

Shackled and handcuffed and clad in a hospital gown, Mr. Montoyo quietly told reporters he was "sorry" as he was led to arraignment before Magisterial District Judge Alyce Hailstone Farrell on Sunday afternoon.

According to a criminal complaint filed by Taylor Patrolmen Kevin Froese and Ryan Deluccie, the victim's family hosted an Independence Day picnic Saturday in their yard. Although unknown to the family, Mr. Montoyo attended as a friend of a friend.

The victim went to bed at about 10:30 p.m. At 2 a.m. Sunday, her parents began to clean up and checked on their children, only to find the victim's door locked. The mother knocked on the door and after a few moments, the girl opened it and ran out, her face red and swollen and her underpants on backwards. Mr. Montoyo was found under a bed wearing only tennis shoes and a T-shirt, police said. The father entered the room and cornered the man until police arrived.

Investigators found the girl's nightgown stained with blood and feces. At Community Medical Center, Dr. Michael Rogan of the Children's Advocacy Center and emergency room physician Dr. Vincent Pollino cataloged the girl's injuries: Severe bruising and cuts to the back, bruising and bleeding around the eyes consistent with strangulation, adult bite marks on shoulder and thigh, adult hand marks on her neck and right cheek and rape-related injuries significant enough to require surgery.

In court Sunday, Mr. Montoyo sat with his head down and hands tightly clasped, his knees shaking as the air conditioner kicked on.

As Judge Farrell contemplated bail, Mr. Montoyo noted that he had lived in the area for eight years, and in Brooklyn, N.Y., for 13 years before that. He told the judge he was born in Colombia, is married, has a job and two grown children.

First Assistant District Attorney Gene Talerico said given the heinousness of the crime and Mr. Montoyo's connections to Brooklyn, Colombia and Costa Rica, he would argue for "significant bail," although he did not specify an amount. Judge Farrell set bail at $200,000, and Mr. Montoyo was committed to the Lackawanna County Prison.

"In case someone posts this, you are not to have any contact with this little girl - not you and not anyone through you," she warned.

When asked if he had anything to say, Mr. Montoyo told the judge "I am sorry for real. I never did anything like this before in my life. It is stupid."

Mr. Montoya's preliminary hearing is scheduled for 10 a.m. July 15, in county court.

This is to the people who blame the park manager and the company who owns it... how can you put blame on them when they did a criminal backround check and he passed? Are they supposed to be psychic? And say oh this one is going to do such a horrenduous act of violence against this little girl 2 years from now,but we'll let him in anyway this way we get his rent until he goes to prison.... COME ON GIVE ME A BREAK!!! It is a horrible horrible tragedy what happened to that poor little girl and her family... but to put the blame on a specific person or persons besides the ANIMAL who did this viscious crime is rediculous. I also live at Maple Manor and I know since ARC has taken over, the park is a hell of alot better than it was 5 years ago.... and let's face it people no one put a gun to our heads to make us move there!! I saw park management out and about yesterday they weren't hiding ANYTHING the park manager is always out in our park... you act like she and this company shoved the guy through the window of this little girl. FYI- I know Frank prosecutes juveniles. When I typed it, I should have proofed it better to state "As the judge in charge..." We need tough judges that are fair. I am sick and tired of liberals that hand out slaps on the wrist to violent offenders and repeat offenders... then stick it to hard working, honest people that make simple mistakes.

No other country allows thier illegal aliens to run around like they own the country and calls thier own citizens potential terrorist. I do not know if montoya is an illegal, but he is NOT American. Our gov't doesn't even have a reporting system to determine how many arrests of illegals there have been. The only facts are held at state level DOCs.

I am sick to my stomach just thinking about what that poor child went through. All the guy could say was that it was, "stupid" I live in Maple Manor and see little 3 and 4 yr old girls out playing in the street without supervision, I do hope this opens the eyes of parents. You never know when some insane person will abduct them. Granted this particular incident was not at all the parents fault. But as I said, I see little girls playing in the street all the time. Parents please keep your children supervised outside and keep your doors locked. This guy could have grabbed any one of those little girls at anytime. I honestly don't know what the ARC management can really do to prevent this type of thing from happening. They do criminal background checks on everyone. However, they can handle complaints a little better. Thinking that a Neighborhood Watch should be initiated. My prayers go out to this little girl and her family.

I think that everyone who has posted to this article should appear at the hearing of this man and be heard. I am very willing to do so. Maybe a large public reaction can help the judge see the light in this case. I would hate to see this man get deported and allowed to live his life. This crime was way to serious and way too close to home.

And about the Times publishing this I understand where you are coming from but if they didnt we would not know and I want to know. A man had the b***s to sneak in a home that s something we need to know. These animals are getting worse and I believe the public must be aware of it.

The reality is this happens and we have to find ways to protect our children and selves fromt hese poeple. Our laws have to be more strict regarding these matters. Our childrens lives are being devistated by these sex crazy men. There are three in the headlines today. Teachers, herion addicts and an illegal. Come on. Enough is enough.

Kelvis- what law are you talking about? Bail does NOT have to be set for violent offenders that are a flight risk. You mean there is no such thing as remand in this state? if not, then the legislature better do something about it.

My heart breaks for this sweet little baby girl..because at five years of age that is what she still is ! God be with her & the family in the pain & suffering they will continue to endure from the damage of this this attack on her ! In my mind the word RAPE is far to mild to be used cover this crime. It would be decribed best as Severe Attack/Rape to an innocent child by a wild out of control Animal ! If an wild animal like a wolf or bear was caught attacking a person like this for food to servive we would think nothing of shooting it dead on sight, but when a sick animal who is suppose to have human feelings does this "for sex" we allow it to not only live but give it the chance to be "Let Free On Bail" so it can flee somewhere and probably do this to another innocent victim ! Shame on all of us who make laws or not make laws that would allow such a thing to be possible. This is not a case of who done it...the animal was caught in the act attacking this child and would have left her body for dead most likly if he was not interupted and caught when he was. Who cares or wants to know what he was like or what he did or didn't do before this ? Why do we look for excuses when a person goes over the line and becomes the equal of a sick rabbied vicious animal when it is past the point of it making a difference ? It is time to act and rid society of such a creature once it has gone mad enough to attack and to harm to an innocent child or anyone for that matter !!! The real shame of this is the fact that had the family "done what instinct tells us to do ..Protect our children & loved ones" and lost it at the time and killed this animal/person they would probably not be able to make bail and end up with major court cost or serve time in prison. Again be the victims of laws that are not in force to protect people from the sick criminals that we are seeing all the time in the news! We all need help for changes to prevent this from happening again and again !!!

All i can say is, this guy is lucky that i'm not a judge. I would have him castrated, locked up and tortured for the rest of his life. Then i would make it known to the public what was done to him so that no one would ever think about hurting another child. This whole story makes me sick!

I said it once, I'll say it again. This area is going to hell in a hand basket. These scumbags are coming from the bigger cities, and from out of the country, and don't abide by the laws of the land. Statistics will show, that 85% of the violent crime in our area in the last 20 years are done by individuals that were not from here, and have never had family here. So you can blame this all on the LOVELY sister for glorifying this area, with her flyers and her billboards. She promises these people a better life in NEPA, by advertising us in the armpits of the east. Blame her, period.

I cannot believe the scumbag that did this can possibly be bailed out. Shame on the judge. Shame on anyone that would post the bail for this lowlife. I just dont understand how bail could even enter the judge's mind when this lowlife scumbag admitted to the crime.

People please, Judge Farrell was following the letter of the law.I have brought many suspects in front of her throughout my career and she has always been on the side of the victim. You are all being too harsh on a very professional and caring member of the minor judiciary.

This is a horrific thing that has happened. It affects all of us on so many levels. I am so glad he was caught in the act and I do hope that justice is served. All my prayers are with this little child and her family. As a side note, I keep wondering what the father had to do to keep himself from beating, knifing, or shooting the rapist to death when he found the son-of-a-b---- with his child. I could not have been so merciful.
