Court won't hear appeal on 113th

SCRANTON - The state Supreme Court has refused to hear an appeal arising from the 2008 primary election race between Democrats Kevin Murphy and Frank Shimkus in the 113th Legislative District.

Mr. Murphy argued the county board of elections violated the Election Code when it counted 466 write-in votes for Mr. Shimkus even though voters failed to blacken the oval next to his name. Mr. Murphy, who won the Democratic nomination, went on to win the general election.

A panel of county judges in June declined to reverse the election board's decision. Commonwealth Court dismissed Mr. Murphy's appeal in December.
